Acceptance of These Terms

These Terms of Service ("Terms") govern your use of The Foundry Event Space website. By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.

These Terms apply only to the website and preliminary communications. A signed venue rental or event services agreement will contain the binding terms for an actual event and will control if it conflicts with these Terms.

02

Website Purpose

The website provides general information about The Foundry, including its spaces, event types, features, and ways to contact our team. Images and descriptions are illustrative and may reflect staged events, seasonal styling, or configurations that are not available for every booking.

You must be at least 18 years old, or use the website with the involvement of a parent or legal guardian, to request services or enter into an agreement with us.

03

Tours, Availability & Inquiries

A tour request or email is an inquiry only. It does not reserve a date, confirm venue availability, create a hold, or form a contract. Tour times remain subject to team confirmation.

No booking is created online

An event date is secured only after all required documents are signed, required payments are received, and The Foundry provides written confirmation.

Please provide accurate contact and event information so our team can respond appropriately.

04

Event Agreements & Pricing

Pricing, capacity, included services, deposits, payment schedules, vendor requirements, insurance, cancellation, rescheduling, damages, and event rules will be stated in a separate proposal or agreement. Website information is not a binding quote and may change without notice.

If you book an event, your signed agreement—not this website—governs the venue relationship, event services, and applicable remedies.

05

Acceptable Use

You agree not to:

  • use the website for unlawful, fraudulent, abusive, or misleading purposes;
  • attempt to interfere with the website, its hosting, or its security;
  • introduce malicious code or use automated tools to overload or scrape the site without permission;
  • impersonate another person or misrepresent your affiliation; or
  • copy, republish, or commercially exploit website content except as allowed by law or written permission.

We may restrict access when reasonably necessary to protect the website, our guests, or our business.

06

Intellectual Property

The website's design, text, branding, graphics, photographs, video, and other content are owned by or licensed to The Foundry and are protected by intellectual property laws. The Foundry name and related marks may not be used in a way that suggests endorsement or affiliation without written permission.

You may view the website and share links for personal, non-commercial event planning. No other license is granted.

07

Third-Party Services

The website may open or link to third-party services such as your email application, map provider, or social media platform. We do not control those services and are not responsible for their availability, content, security, or practices. Your use of them is subject to their own terms and policies.

08

Disclaimers

The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties relating to the website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We aim to keep information accurate and the website available, but we do not guarantee that all content is complete, current, error-free, or continuously accessible. Nothing on the website is legal, financial, or professional event-planning advice.

09

Limitation of Liability

To the fullest extent permitted by law, The Foundry and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of—or inability to use—the website.

Our total liability for a claim arising solely from use of this free website will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you. Liability relating to a booked event is governed by the applicable signed agreement.

10

Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising solely from these Terms or use of the website will be brought in the state or federal courts located in Fulton County, Georgia, unless applicable law requires otherwise.

If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it.

11

Changes & Contact

We may update these Terms from time to time. Changes take effect when posted, and the date at the top identifies the latest revision. Your continued use of the website after an update means you accept the revised Terms.
